But is that actually true? No, it\u2019s not\u2014temporary letting is still very much possible. Whether you&#8217;re moving abroad for a while, waiting for your property to sell, or want to hold onto an investment \u2014 there still are viable options.<\/p>\n<p class=\"\" data-start=\"535\" data-end=\"832\">It\u2019s important, however, to fully understand the applicable rules and use the right contracts. That way, you avoid unnecessary surprises. Don\u2019t be misled by media headlines suggesting temporary letting is no longer allowed. The legislator has deliberately kept several options for temporary letting.<\/p>\n<h2 data-start=\"834\" data-end=\"862\">So what\u2019s still allowed?<\/h2>\n<p class=\"\" data-start=\"864\" data-end=\"1028\">Since the Fixed Rental Contracts Act came into force on 1 July 2024, temporary letting has been restricted\u2014but the following situations are still permitted:<\/p>\n<p data-start=\"1030\" data-end=\"1083\"><strong>Temporary letting with a diplomatic clause<\/strong><\/p>\n<p class=\"\" data-start=\"1084\" data-end=\"1306\">Ideal if you&#8217;re temporarily living elsewhere and plan to return to your home. This contract includes a minimum term, optional extensions and a fixed end date at which the tenant is legally required to vacate the property.<\/p>\n<p data-start=\"1308\" data-end=\"1361\"><strong>Fixed-term contract (maximum of two years)<\/strong><\/p>\n<p class=\"\" data-start=\"1362\" data-end=\"1634\">This is the contract type that has been most discussed in the media. It&#8217;s true that in many standard cases, it can no longer be used. However, this model remains valid for specific target groups, such as students, recently separated parents, or urgent cases.<\/p>\n<p data-start=\"1636\" data-end=\"1682\"><strong>Letting under the Dutch Vacancy Act<\/strong><\/p>\n<p class=\"\" data-start=\"1683\" data-end=\"1893\">There are several conditions to meet when using this contract, including applying for a municipal permit. Once approved, the contract is ideal for properties that are for sale or scheduled for either demolition or renovation.<\/p>\n<p data-start=\"1895\" data-end=\"1928\"><strong>Target group contracts<\/strong><\/p>\n<p class=\"\" data-start=\"1929\" data-end=\"2075\">Letting to specific groups\u2014such as students or large families\u2014can still be done using specially designed contracts tailored to these groups.<\/p>\n<p><strong>Extension after 1 July 2024<\/strong><\/p>\n<p class=\"\" data-start=\"2113\" data-end=\"2326\">The Fixed Rental Contracts Act has not just restricted temporary rentals. It&#8217;s also introduced two new options: trial cohabitation contracts and renting to first-degree family members. Both options come with strict conditions and everything must be carefully outlined in the rental agreement.<\/p>\n<h2 data-start=\"2328\" data-end=\"2355\">Avoiding legal pitfalls<\/h2>\n<p class=\"\" data-start=\"2357\" data-end=\"2711\">Tenants in the Netherlands enjoy heavy legal protection, and tenancy law is mandatory law. This means that what you write in a tenancy agreement doesn\u2019t always take precedence\u2014the law does. Even a small contractual error can give a (intended) temporary tenant the right to remain indefinitely.
